The use of this site is governed by the TERMS AND CONDITIONS set forth below. Your visit or purchase within this website indicates your acceptance of these terms and conditions. Please read them carefully before you buy.
In these terms and conditions Protac International Computers (Australia) Pty Ltd is referred to as "Protac", "us" and "we", and customer is referred to as "you".
We reserve the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
Sales Area
We only sell and ship Products within Australia, and do not make deliveries outside of Australia.
Legal Capacity to Transact
You can not place orders within this website if you are under the age eighteen (18) years. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years.
Should Protac suffer any damage or other losses as a result of a transaction entered into by a minor, Protac reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Protac.
Product Descriptions
Protac attempts to be as accurate as possible. However, we do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Protac itself is not as described, your sole remedy is to return it in unused condition.
Placing Order
All orders placed, including pre-paid orders, are subject to confirmation and acceptance by Protac. Protac reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
Customer should place order via our on-line ordering system whenever possible. When our on-line ordering system is malfunctioning you can submit order by email or fax. We do not accept phone orders except for dealers.
Protac may vary prices for received orders in the event of price changes or mistakes made by suppliers. In the case of price increase, you may cancel the order by giving notice to Protac, which must be received within seven days of the price increase notification.
Quantity in stock displayed on our web site should be considered as a guide only. It is possible that an order placed earlier will receive the allocation of the product in which the quantity for it showed as in stock at the time of your order.
Any attempt to cancel an order must be made within 24 hours. Cancellations attempted after the dispatching will result in the customer having to pay the shipping and handling charges on the package and the cost of shipping the package back. Cancellation of order can be communicated by email or fax by quoting your order number. Cancellation of order for any assembled system will incur AUD75.00 for restocking and labour cost.
Payment
The pricing on this website is in Australian Dollar Only, and we only accept payment in AUD.
For delivery orders, accepted payments include credit cards (Visa/Master), direct deposit, internet transfer, cheque and money order.
For pick-up orders, accepted payments include cash, EFTPOS, credit cards (Visa/Master), direct deposit, and internet transfer.
Payment processing will not begin until we receive all the information we need. You may be required to provide further identification for additional security reference checks.
Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day. Business days are Monday through Friday, excluding Public holidays.
We are unable to accept credit cards issued by banks outside of Australia.
Where you pay by direct deposit, internet transfer, cheque or money order, you must pay the price payable in Australian dollars as indicated on your order confirmation within 7 days from the date that you receive your order confirmation. If the payment is not received within 10 days from the date that you receive your order confirmation, Protac reserves the right to cancel the transaction.
Direct deposit, internet transfer requires overnight for the fund to be cleared. Cheque deposit will take 4 to 5 working days to be cleared.

Shipping
Unless otherwise agreed by us, we will ship your products to the delivery address indicated on your Order Confirmation. Please note:
- We do not ship to PO Boxes;
- Customers are responsible to have someone at the delivery address to sign for and accept the delivery;
- Customers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods;
- Cost for re-delivery attempts will be passed to the customers if the delivery address is unattended at the time of delivery.
- Protac will make every effort to deliver on time. However, we shall not be held liable for delay or lost shipment
Title and risk of loss to all Products will pass to you on delivery.
Pick Up
Customer may pick up the ordered products from our Sydney, Melbourne or Perth offices. Check “ Contact Us” for office locations.
Payment should be cleared before or at the time of pick-up.
Return and refund
There will be no credit given on order price difference, due to price drops. Please select carefully at the time when you place your order.
Returns for refund will only be accepted within 7 days of goods receipt. No refund will be given to you until Protac has received the returning product from you. A restocking fee of AUD35.00 per item will be deducted. Returned goods must be in its original condition and include all the original packaging. Shipping and handling cost are not refundable. This return for refund policy is applicable for change of mind, and lack of expertise for installation.
Any incorrect, missing or damaged items received must be reported to us by email, fax or phone within 24 hours of you receiving the delivery. If item(s) received is not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.
Protac owns the title of any extra goods shipped with your order that have been dispatched in error.
Dead On Arrival Products - "DOA"
A Protac product is considered DOA if it shows symptoms of a failure, or is discovered to be broken when first taken from its packaging. DOA product must be reported within 7 days from the time it is received, and the product must be received by Protac within 14 days. Failure to report a DOA product within 7 days will result in you not being able to claim the item as a DOA.
A Protac customer service member will provisionally determine whether the product is DOA. Where a product is provisionally determined as DOA, Protac will provide a replacement for the product. In the case of a replacement product not being available, Protac will offer refund. No replacement or refund will be given until Protac has received the DOA product from you.
If the product is deemed by Protac NOT to be DOA, Protac may in its absolute discretion refuse to replace the product or offer you a refund for the product.
Protac reserves the right to test any returned DOA product. If the condition of the product was misrepresented to us by the customer, Protac will impose AUD35.00 handling and administration fee.
Please refer to the warranty section for claim procedures regarding DOA Products.
Warranty claim
Protac provides 12 months return to base warranty for most of our products, except the following items offered by manufacturers:
- Notebook Batteries: 6 months
- Motherboards and Graphic Cards: 24 months
- LCD Monitors: 36 months
Warranty only covers the product(s) sold by Protac. Warranty does not cover any other equipment used in conjunction with the product(s) sold by Protac.
Protac does not handle warranty claim for those goods where the manufacturer accepts direct warranty claims from customers, e.g. Brother Printer, Fax, Labeller, etc.
Customers must request a RA (Return Authorization) number prior to returning any DOA or faulty products to Protac. Please fill in the warranty form (download) and sent to us by email or fax, our customer service will issue you with a RA number. RA number is deemed effective for only 7 days from the day of issue. RA number is only issued when we consider the item is in fact faulty from the descriptions provided by the customer.
If the returned goods are determined by Protac to NO Faulty found, Protac will impose AUD35.00 handling fee for examining these goods where no fault was found.
All warrantees are voided if returned product is found in any way to be mishandled, uninstalled, modified, tampered, abused, physically damaged or used under wrong voltage etc.
Protac is not responsible for data contents or the security of the data contents contained in any returned goods. Recovery and reinstallation of system and application software and user data are not covered under any Protac warranty.
Protac will not be responsible for direct, special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to lost profits, downtime, goodwill, damage to or replacement of equipment and property, any costs of recovering, reprogramming, or reproducing any program or data stored in or used with Protac products supplied to you, and any failure to maintain the confidentiality of data stored on the product.
When a product needs to be returned to Protac for replacement or a refund, Protac will in no manner whatsoever be responsible for any data you may leave on the product.
Customer is responsible for proper packaging of RA returns. All warranties will be void on items that are insufficiently or inaccurately packaged. Customer is responsible for all the shipping charges associated with returning the defective merchandise. If any product(s) returned for warranty claim is determined to be physically damaged, the product(s) will be returned to the customer as is.
Customer is responsible for any shipping and insurance cost involved in sending the warranty claim goods back to us. Protac is not responsible for any parcel missing in transit on its return back to us.
Our Liability
We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
Our maximum aggregate liability for any product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the product(s) in question.
Credit Card Fraud
Whilst this site is fully secured by a certified 128bit Secure Sockets Layer (SSL) connection for its transactions with our customers, Protac will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
Dealer Access
Protac allows dealer pricing access to legitimate computer resellers who supply their ABN details. Although all efforts are made to ensure up to the minute dealer pricing, there may be rare circumstances whereby market fluctuations, stock shortages and other unforeseen conditions make supply at the listed dealer price not possible. Similarly, the freight calculation system is primarily designed for retail usage and for bulk purchases or larger orders it may be possible an erroneous costing be given. Under these circumstances Protac reserves the right to adjust the order costing for the dealers final approval.
Force Majeure
Protac shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Protac, and Protac shall be entitled to a reasonable extension of time for the performance of such obligations.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
Disclaimer
Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice.
